Yes...as long as she is an owner on an account they can take money from the account, even if she is not the primary owner.

Unfourtonalty the Patriot Act does not allow you to just remove a person from an account unless one of the owner's has died. If you are over 18 and an owner on the account you have all rights to close the account and open one in only your name. If you are under 18 you would need another adult on the account in order to open a new one.

You would actually need to open a new account in your name only. Withdraw all of the money in your current account and close it. When you open your new account, don't put your mom on it. It doesn't matter if she's the primary accountholder or not, she's still on your account. In the eyes of whoever is receiving the levy, the money in your account is hers as much as it is yours.

Anyone able to sign on any account is up for grabs. The levy is put on the account and not just the person. Knowing the banking society I would think that even by removing the name they would still take the money. You might check with your bank. Levys are a legal means to attach a bank account and the bank must respect it or lose their charter. The levy must stay on the account until the complete payment is made. You should have received a report as to the amount.

There is a way to "correct" this challenge - close the account and change banks. Withdraw any funds in the account and DO NOT tell anyone at the bank where you are going. Any future payments should not be used with the new bank check or you will go another round.

Open an account in your name only.
Withdraw the money in the joint account.
Deposit the money in the new account.
